Background Screening Expert Returns from World Tour with Enlightened Vision of International Background Investigations

With the spectrum of terrorism worldwide continuing to be ever present and the unprecedented rise of employee fraud, identity, information and property theft as well as the usual suspects of workplace bullying, harassment and violence, the 21st century business community is under siege. Not surprisingly due to the above affront on the business world background screening has grown geometrically to the point that over 25 million checks are being done annually.

As short as five years ago background screening was virtually exclusively a tool used by businesses in the U.S., however, as multinationals, offshoring and global businesses continue to grow so has background screening. Today there are flourishing background screening industries emerging in India, United Kingdom, Canada, Singapore and Australia. Recognizing the worldwide growth of the industry the National Association for Professional Background Screeners (NAPBS which is the trade association that represents background screening firms) tapped the expertise of renowned workplace violence prevention and background screening expert, W. Barry Nixon, SPHR to lead an effort to establish an international network of background screening firms from around the world. He is also the author of the Comprehensive Guide for Selecting a Background Screening Firm and the soon to be published book, Background Screening and Investigations: Managing Risk in the Hiring Process. In his effort to establish this international network, Mr. Nixon recently traveled to Amsterdam, Netherlands to attend the Business Forums International’s 2007 European Pre-employment Vetting & Screening Summit and the Background Investigator’s India Pre-employment Screening Conference in Bangalore, India. The knowledge and insights gained from dialoging with members of the international background screening community has expanded Nixon’s understanding of the challenges of conducting investigations in countries around the world.

“Barry Nixon believes that we are in the midst of the birth of a global marketplace for background screening that will impact hiring practices around the world.” At a time when companies around the world are faced with expanding their search for talent in key skill areas they are also being faced with the need to put extra scrutiny on individuals being hired from outside of their country borders. The true challenge that companies face as they embark on this background screening journey is to balance the need for standard practices with the unique requirements that are present in each country. The following are some of the top challenges that business must address to be successful in the international background screening arena:

1.Legal system, definition of crimes and access to records – International criminal checks require an understanding of each country’s court system, how criminal records are created and maintained, where searches should be conducted (court house, police station, central records bureau, etc.), the type of records that are available and what the records mean. It is critical to understand the definition of crimes in every country which vary significantly. It is also important to stay within legal guidelines that are applicable in both the home country and the foreign country.

2.Data Protection, Privacy laws and other legal regulations – Many countries have a Data Protection law that regulate who has access to records, admissible purpose for using the records and transmission of the records across their country borders. In addition there are various Human Rights and Labor laws that must be adhered too.

3.Work schedules and time to conduct searches – Since each country has its own holiday schedule, prime time for vacations, sometimes communications are delayed because of a country’s calendar. The average turn around time for a background checks in the U.S. is around 3 days or less, however, this turn around time can vary significantly when communicating with researchers, past employers or schools in other countries. For beginners, there can be delays due to time differences. For example, if you place an order today at 10:00 AM PST it is 11:30 PM in Mumbai, India which means your order is not received until the next business day so a day has already been lost. Add to this the need to access records kept in a rural police station that it takes days to get too and I’m sure you get the picture. If that wasn’t enough on top of that you have to

adjust to the reality that different countries have different views and definitions of time itself. Remember your first trip to the Caribbean and how you had to adjust your thinking about time.

4.Language – Your firm or agent must have the ability to communicate in the language and possibly dialects of the country you are accessing criminal records, foreign schools and employers’ records from.

5.Modes of communication – E-mail may be your preferred mode, however, email reliability varies from country to country. Fax communications appear to be used very frequently.

6.Cultural nuances and local practices – You must be versed in the local customs that can impact the background checking process, e.g. naming customs, assignment of an country ID number, University Seat number, etc.

7.Cost and Payments – Factors that may impact cost include nature of court system, type of records maintained, how and where the records can be accessed, time to process, etc., as well as the modes of communication, e.g., email vs fax. The means of payment will vary and could be by wire transfer, money order, credit card, etc. Sometimes you will encounter the need for records to be translated which will add to the cost or the need to locate phone numbers for employment and educational checks.

According to a recent study of the background screening industry conducted by KPMG the background screening industry is a 2-3 billion dollar industry. Nixon says that “while the U. S. market will continue to grow albeit at a slower pace, the international background screening marketplace will be where the real growth will occur well into the next decade.”

True story from the archives of inanity:

I began my career as a paperboy at age 11. My older brother was a front (in Wisconsin you had to be 12 to draw a wage) and quite the 12 yr. old capitalist. He did 1/4 of the work and skimmed 2/3 the profit. As soon as I was 12 he ordered me to "pay the bill" which meant a Fri. night bus ride to the Kenosha News offices to spill oodles of small change in front of the awesome teens who actually got paid to drive vehicles and drop off bundles of the daily drivel then drive those trucks to the next drop spot.

After the money counting I’d stop off at The Dutch Maid for an ice cream and a good drooling which was delivered as a godsend from the largess of the waitress who never fully buttoned her uniform top. In sub zero weather I would stand outside reconnoitering which were her tables that particular night. Sometimes it took 15 freezing damn minutes to determine, then occupy one of her tables! When she delivered the ice cream she would casually and enticingly lean far over the table revealing just the right amount of cleavage so she could hear a 12 year old stifled gasp. This older woman, nearly 17 as a good guess, left my impressionable mind so boggled that for years I had crushes on girls at least 1 year my senior. That fetish still has a grip on me 5 decades later. I sometimes lie awake at night imagining I could pull her address up on a Google search so I could send her a bottle of fine wine as a thank you for all she has done for me. But I digress. And I can’t blame my digressions on ample bosoms.

This tale of preteen lust does have a car connection. I hope I haven’t bored you getting to it.

From the ice cream and dream emporium there was only a lonely trip home. It was a 3 block walk to the bus stop in front of S.S. Kresge’s Five and Dime (later to evolve in a series of steps into Jupiter and finally into K Mart) and a wait for either the Red Line or Blue Line electric trolley car ride home.

A miracle happened one cold March Friday night. A gleaming red ’57 Chevrolet Bel Air containing a rolled and pleated Naugahyde interior and powered by the almost mythical Chevy V8 topped with 3 Holley 2 barrel carbs pulled up to he curb and I heard those cherished two words every paperboy on the corner only dreams about, "Hop in."

My 18 yr. old cousin Wayne was at the wheel with 3 of his old and new neighborhood (emphasis on HOOD, a term more of respect than dread) cronies inside. I of course got the "gork” seat between the back two bruisers who I didn’t know at all. That was a blessing because riding shotgun in the front next to Wayne was the scourge of the neighborhood, a bullying "Older Brother" named Dean Olmstead.

I held back my objections when the biggest jerk on the south side, Dean, suggested Wayne take me right home in case they found a couple of babes who wanted to "Scoop the Loop" in a slick new Chevy. I guess the disappointment of not being almost seen on repeated trips around the downtown Friday night scene was overshadowed by the pride with which I stepped into every boy’s Dream Machine in front of 5 or 6 of my fellow peasant paperboys.

Wayne did allow me the thrill of one awesome circumlocution before heading homeward on the less traveled 7th avenue route. That turned out to be a wise choice when only 6 blocks into the trek Wayne leaned far to his right and let loose with a nostril hair curling silent but oh so deadly humdinger of a fart to write home about. As the realization of what had just transpired wafted around the the front seat and made it’s way to the back seat pandemonium broke out. Dean was punching Wayne in the upper arm. One of my back seatmates began howling a mournful objection While the guy on my right commenced to howl with uncontrollable laughter. Dean now decided to attempt to vent his theatrical rage on "laughing hyena guy" when I could no longer hold my breath and joined in giggling like a ticklish toddler. Dean then tried to grab my hat and also got a handful of hair, a trick he was known and despised for by every youngster on the block and none more than me. I’d seen him carry his kid brother, my best friend Jamie, 10 feet by only his hair. My new protector to the right nearly broke dean’s arm and he let go before I had a chance feel any serious pain.

At this point Cousin Wayne wisely pulled over to the curb, possibly to prevent the premature venting of all his particles of hard work from escaping out of the simultaneously opening 3 windows. He sat quietly face forward while the other buddy’s objections died down. I was still gasping with laughter as Wayne slowly swiveled to face the 4 of us, waited for his moment and uttered the words that almost put me in the Saint Catherine’s Hospital emergency ward with a case of split side due to terminal gasping for more air to laugh with. He calmly and confidently said, "I thought that was rather refreshing."

Today (or rather, the day that this photograph was taken, Thursday 22nd October, 2009) a programme was broadcast in Britain on BBC – Question Time – that has caused a few ripples. For those unaware, most likely those on the far side of the pond, Question Time is a political debate programme, tackling current issues, debated by the great and the good of the political, cultural and academic spheres.

Today, for the first time ever, the leader of the British National Party, Nick Griffin, was on the panel. The BNP is a far right minor political party, but has recently won two seats on the European Parliament. The BNP is "committed to stemming and reversing the tide of non-white immigration and to restoring, by legal changes, negotiation and consent the overwhelmingly white makeup of the British population that existed in Britain prior to 1948". They are considered by a majority, including this writer, to be a thoroughly detestable gang of racists, bullies and criminals.

The programme was a fascinating spectacle, and it should be easily available to watch via the wonders of the internet; it is definitely worth watching. There have been claims of bullying and victimisation of Nick Griffin, and while it is certainly true he was not given the fair audience that he has never earned the right to, he showed himself to be ignorant, arrogant and generally unpleasant. He has a very effective PR machine that glosses over his Holocaust denial, his ties to the KKK and his many previous crimes against decency, morality and humanity. But when faced with direct questioning, without time for preparation he came across as unintelligible and petty.

However, there are a few points I found myself wanting to make regarding the discussion in the programme. The first was regarding Islam, where he was asked to defend his opinion of Islam as a "wicked, vicious faith". He talked about the denigration of women, treatment of them as second class citizens and incitement to violence against non-believers. What he has clearly misunderstood, and which nobody, sadly, bothered to point out to him, is that these are not matters of the faith – the Qur’an does not mention these behaviours. These are cultural and social behaviours, present in only some countries, perpetrated under the banner of religion, in the same way that evil deeds have been committed throughout history under the banner of most religions.

The second was his concept, that was repeated regularly, of the indigenous peoples of Britain, the population he wishes to return to. There is no indigenous population of Britain, nor northern Europe for that matter. 17,000 years ago, we were covered in ice, and as one of the panel mentioned, we didn’t live on the ice. When this receded, people moved north into these areas. These were our first settlers – a celtic pagan society. Since then, we have been invaded by the Romans, Anglo-Saxons, the Vikings and the Normans. Our religions, cultures and language have been added to, shaped and altered by these successive invasions. There is no “aboriginal” (Griffin’s word, not mine) religion or culture. Even the concept of Christianity, the society they wish to return to, was introduced to our country by an invasion, which they are theoretically trying to now prevent.

The BBC were heavily criticised for allowing him onto the programme. There were major protests outside the studios. Even the Government suggested that the BBC shouldn’t have allowed it to proceed. I am on the side of the BBC. I think they did the right thing in allowing him to reveal his true self, as a small, insignificant, unpleasant racist. And as they responded to the Government’s condemnation, if they feel it’s so wrong for him to voice his opinion, they have the power to ban the party.
